1. Acceptance of Terms
By accessing or using the Service (referred to as "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Description of Service
The Service is a web and mobile application designed to help users plan, track, and optimize their gardening activities. The Service includes features such as plant identification, watering schedules, seed inventory management, weather-based recommendations, and community sharing. The Service is offered in both a free version and a paid Pro version.
3. User Accounts
3.1. Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2. Account Security
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3.3. User Types
The Service offers different user roles, including individual users, family members, and Pro subscribers. Each role may have different access levels and features.
4. Payment Terms (Pro Version)
4.1. Platform-Specific Billing
- Android App Users: If you download the Service through Google Play Store, all subscriptions and in-app purchases are processed through Google Play Billing. Google's payment terms and policies apply, and subscriptions are managed through your Google Play account. Refunds are subject to Google Play's refund policy.
- Web Users: If you access the Service through our website or other platforms, subscriptions are processed through our designated payment processor.
4.2. Subscription
The Pro version of the Service is available for a subscription fee. By subscribing to the Pro version, you agree to pay the subscription fee through the applicable payment method for your platform.
4.3. Billing
Subscriptions will automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may cancel your subscription at any time through your account settings or the applicable platform's subscription management system (e.g., Google Play subscriptions for Android users).
4.4. Refunds
Refunds are subject to the policies of the platform through which you purchased your subscription. For Google Play purchases, refunds are handled according to Google Play's refund policy. For web purchases, we do not provide refunds for partially used subscription periods, except as required by law.
5. User Conduct
5.1. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are prohibited from using the Service to:
- Post or transmit any content that is unlawful, defamatory, obscene, or otherwise objectionable.
- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Upload or transmit viruses or any other type of malicious code.
- Interfere with or disrupt the Service or servers or networks connected to the Service.
5.2. User-Generated Content
You retain ownership of any content you submit to the Service (e.g., garden snapshots, plant identification results). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Service.
6. Intellectual Property
6.1. Our Property
The Service and its original content, features, and functionality are and will remain the exclusive property of us and our licensors.
6.2. Trademarks
The name and logo of the Service and other product names are trademarks of ours and may not be used without permission.
7. Disclaimers
7.1. Service Provided "As Is"
The Service is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7.2. Gardening Advice
The Service provides gardening recommendations and information based on available data and algorithms. We do not guarantee the accuracy, completeness, or usefulness of any gardening advice, and you use such advice at your own risk.
8. Limitation of Liability
In no event shall we, our officers, directors, employees, or agents be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of the Service.
9. Indemnification
You agree to indemnify and hold harmless us and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in connection with your use of the Service or violation of these Terms.
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

14. Third-Party App Stores
If you download or access the Service through a third-party app store (such as Google Play Store or Apple App Store), you acknowledge and agree that:
- These Terms are between you and us, not with the app store provider
- The app store provider has no obligation to provide maintenance or support for the Service
- The app store provider is not responsible for the Service or its content
- You will comply with the app store's terms of service
- The app store provider and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of the Service through their platform
